1. HOW TO ENTER: No purchase necessary. Sweepstakes starts September 6, 2008 at 12:00 p.m. CST and ends October 12, 2008 at 6:00 p.m. CST.
To enter, provide all required information at www.paradeofhomes.org (the “Website”) or hand print the same information on an entry form (available at Parade of HomesSM homes) and mail it to Parade of HomesSM Fall 2008 Sweepstakes, c/o The Builders Association of the Twin Cities, 2960 Centre Pointe Drive, Roseville, MN 55113.
Mail-in entries must be postmarked by midnight, Monday, October 13, 2008, and are limited to one entry per outer envelope. Limit one entry per 24-hour period, irrespective of method of entry. No photocopies or other mechanical reproductions allowed. Not responsible for incomplete, lost, stolen, late, misdirected, garbled, or postage due entries. All entries become the property of Sponsor and will not be returned.
Every on-line entry submission must be manually keystroked and manually entered by the individual entrant; automated and/or repetitive electronic submission of entries will be disqualified.
The name of the person submitting an e-mail address via on-line entry must be the name of the authorized account holder of such e-mail address, or entry will be void. In the event of dispute over the identity of a potential winner, online entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry, and potential winner may be required to provide acceptable proof of identity. “Authorized account holder” is the natural person who is assigned to an e-mail address by the internet access provider, online service provider, or other organization that is lawfully responsible for assigning e-mail addresses.
Sponsor is not responsible for any computer, online, telephone or technical malfunctions that may occur, for any incorrect or inaccurate information, whether caused by website users, any of the equipment or programming associated with or utilized in the sweepstakes, or any technical or human error which may occur in the processing of submissions in the sweepstakes, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to or alteration of entries or for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, email, players or browsers on account of technical problems or traffic congestion on the Internet, at any website or on account of any combination of the foregoing. Sponsor is not responsible for any injury or damage to participants or to any computer related to or resulting from participating or downloading materials in this sweepstakes. If, for any reason, the sweepstakes is not capable or running as planned, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the sweepstakes in whole or in part and randomly select winners from among all eligible entries legitimately received prior to the cancellation, termination or modification. Notice of any cancellation, termination or modification will be posted on the Website. By entering the sweepstakes, participants agree to Sponsor’s use of their personal information as described in its Privacy Policy, located at the Website. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering or attempting to tamper with the entry process or the operation of the sweepstakes or the Website, violating the Official Rules, or acting in an unsportsmanlike or disruptive matter, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND ALL OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Entry data that have been tampered with or altered are void.
2. ELIGIBILITY: You must be a legal U.S. resident, at least 21 year of age, and residing in Minnesota or Wisconsin at time of entry. Employees and directors of the Builders Association of the Twin Cities (and its members and subcontractors) (together, “Sponsor”) and Relators, MLT Vacations Inc. and marketing agencies of the preceding entities and others involved in the creation, production or execution of this Sweepstakes and their respective family (spouses, parents, siblings and children and their spouses) and household members are not eligible to enter.
3. GENERAL: This Sweepstakes is subject to all laws and void where prohibited. No cash or other prize substitutions or prize transfers permitted. Winners will be solely responsible for all applicable taxes and surcharges on prizes. Winner may receive an IRS From 1099 for the full approximate retail value of their prize as stated in these rules, whether or not they actually use the entire prize. All other expenses related to the receipt and use of the prize not specifically mentioned herein are the sole responsibility of the winner. All or any portion of a prize not accepted or used by winner will be forfeited.
4. DRAWING: Winners will be randomly selected from among all eligible entries received during the week of October 27th, 2008, by an independent judging agency. Odds of winning are solely dependent upon the total number of entries received.
5. PRIZE: Trip for 2 to Hawaii. Roundtrip coach air via Northwest Airlines from Minneapolis to Hawaii valued up to $1,200. Hotel accommodations valued up to $2,800. Prize must be booked by 9/30/09 and is valid for travel through 10/31/09. Total prize valued up to $4,000. A trip certificate voucher with winner’s name and complete details will be e-mailed to winner from Bolin Marketing. Trip certificate has zero cash value. Travel via other NW Airlink and NW designated affiliated partner flights is not included. Travel is subject to availability and blackout dates apply. Travel is not permitted on the following dates: 2008 – November 25, 26, 30, December 23, 27, 28, 29, 30. 2009 – January 4, February 13, 16, April 9, 10, May 22, 25, July 3, 6, September 4, 7, November 25, 29, December 23, 24, 27, 30, 31.
Winner and travel guest must travel on same itinerary and on dates and at times approved by Sponsor. Prize does not include tax, insurance, telephone charges, personal expenses, travel arrangements between winner’s home and airport of departure, ground transportation, parking, gratuities, food, merchandise, souvenirs, beverage or other incidental charges not specified above, all of which are the prize winner’s responsibility. Travel is subject to terms, restrictions, and/or change due to circumstances beyond Sponsors’ control. No extensions will be permitted, and any unused travel or component thereof will be forfeited. Prize cannot be used in conjunction with any other promotion or offer and may not be separated. Tickets issued or accommodations awarded in conjunction with the prize are not eligible for frequent flyer, frequent guest or similar awards programs.
No transfers or cash or other substitutions for any prize, except that Sponsor may substitute a prize, in whole or in part, for one of comparable or greater value in the event advertised prize (or any component thereof) is unavailable.
Travel guest must sign a Liability Release and, except where prohibited, a Publicity Release prior to issuance of travel documents. If travel guest is not age of majority in state of residence, release must be confirmed and signed by his or her parent or legal guardian.
Winner of travel prize will receive a 1099 tax form for full amount of prize listed ($4,000). Sponsor and its agents make no warranties, representations or guarantees relative to any prize, and disclaim all liability for the provision, quality or nature of any third party services provided to winner or travel companion.
6. CONDUCT: By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges that shall be final and binding in all respects. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right at its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes or the Sponsors’ web site; or to be acting in any manner Sponsor deems to be in violation of the Official Rules; or to be acting in any manner it deems to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. Any attempt to deliberately damage the web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws.
7. GENERAL. By participating, entrants agree (a) to the Official Rules and to the decisions of the Sponsor and judges, which shall be final in all respects; (b) to release and hold Sponsor, its parent, subsidiaries and other affiliated companies, advertising and promotion agencies, prize providers, promotion partners and their respective directors, agents and employees harmless from all liability, loss, personal injury or death, or damage to reputation or of any kind attributable in whole or in part, directly or indirectly, to their participation in the sweepstakes or their acceptance and/or use of a prize or travel to or from or participation in any prize-related activity; and (c) if a winner, to Sponsor’s unrestricted use in all media of winner’s name, voice, likeness and state of residence for advertising and promotional purposes, without additional compensation, or right of review or approval.
Any promotion materials including the offer or these Official Rules, which contain production, printing or typographical errors, or are obtained outside authorized or legitimate channels are void; and Sponsor’s liability, if any, is limited to the replacement of such materials. Recipients of such materials release Sponsor, prize providers, promotion partners and their parent, affiliated and subsidiary companies, the judging organization and their respective officers, directors, employees and agents from any and all losses, claims or damages that may result therefrom.
8. ARBITRATION/CHOICE OF LAW. Except where prohibited, participants agree that any and all disputes, claims and causes of action arising out of or connected with this sweepstakes shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by participant with regard to this sweepstakes, but in no event attorneys’ fees, punitive, incidental, consequential or other damages. All issues and question concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and Sponsor and/or Sponsor’s agencies in connection with the sweepstakes shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard for conflicts of law doctrine, and all proceedings shall take place in Hennepin County, Minnesota.
9. LIMITATIONS OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the sweepstakes, or (d) inaccessibility or unavailability of the Internet or the Sponsors’ web site or any combination thereof; (e) any injury or damage to participants or to any other person’s computer which may be related to or resulting from any attempt to participate in the Sweepstakes or download any materials in the sweepstakes. If, for any reason, the sweepstakes is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part.
10. WINNER NOTIFICATION: All potential winners will be notified by U.S. mail and/or e-mail at the e-mail or postal address provided with the entry. Prize winners will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within thirty days of attempted prize notification. If a selected winner cannot be contacted, is ineligible, fails to claim or schedule the prize, or fails to return the information form or publicity/liability release, an alternative winner may be selected.
11. WINNER RELEASES: All entrants, as a condition of entry into the Sweepstakes, agree to release Sponsors, their respective parents, subsidiaries, divisions, affiliates, suppliers, printers, distributors and advertising, promotional or judging agencies, from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons or property which may be sustained in connection with participating in any aspect of the Sweepstakes, the receipt, ownership or use of any prize awarded, any typographical or other error in these Official Rules and/or the announcement of offering of any prize. The winner shall bear all risk of loss or damage to their prize after they take delivery. Sponsors make no representations or warranties of any kind concerning the appearance, safety or performance of any prize. Except for where prohibited by law, winners grant to Sponsors the right to print, publish, broadcast and use worldwide in any media now known or hereinafter known each winner’s name, address, statement, picture or other likeness, without additional compensation, for public relations, advertising and promotional purposes.
12. WINNERS’ LIST: For a list of prize winners, mail your request with a stamped self addressed envelope to PARADE OF HOMES FALL WINNERS LIST c/o THE BUILDERS ASSOCIATION OF THE TWIN CITIES, 2960 CENTRE POINTE DRIVE, ROSEVILLE, MN 55113, postmarked by December 31, 2008.
